COLORADO SPRINGS -18-year old Xavier Montoya is not facing any charges for shooting and killing his step-father last fall. Back September 4th, CSPD was called to a home in the 4500 block of London Lane, off Astrozon and Chelton Rd. on reports of a fight.
When officers pulled up to the house, they found 34-year old Martin Ramirez dead in the middle of the street. According to police, Ramirez was drunk when he began assaulting his 21-year old stepson, Isaac Montoya. Montoya was trying to avoid the confrontation, but Ramirez chased him out of the house and began slamming Montoya’s head into the pavement on the street.
Montoya’s 18-year-old brother shot Ramirez once in the head. The 4th Judicial District Attorney’s office ruled the teen was justified in the shooting because he was trying to protect his brother.
