A huge development in the case of a Fountain man accused of killing his girlfriend. A judge has granted a motion to dismiss the first-degree murder case against Miles Kirby. Kirby was taken into custody on July 27th. Meanwhile, on Friday, the court learned the ruling would change from homicide to suicide. Kirby was then granted a personal recognizance bond.
